CUSTOMER AGREEMENT
Our Commitment to Our Customers Includes:
- Free installation
- Free maintenance service:
- no charge for service call
- no charge for replacement parts
- no charge for replacement of fixture if required
- A rental Sentinal Light can be transferred to the next homeowner if you move or sell your home.
Customer Commitment
- You will pay your rental charges when due, together with interest on any late payments at interest rates we may select, acting reasonably. Rental rates may change from time to time with at least 30 days notice by mail or the local newspaper.
- You will use your Sentinal Light safely and responsibly.
- Please do not allow anyone other than Innisfil Energy Services or its agent to repair, move, modify or disconnect the Sentinal Light.
- You will be responsible for any damage to the Sentinal Light if caused by you or unauthorized third parties, accident or other insurable risks.
- You agree that we may terminate this agreement and remove the Sentinal Light if you fail to meet any of your commitments or with a minimum 30 days notice.
TERMS AND CONDITIONS
Eligibility
Service eligibility is determined by Innisfil Energy Services Limited, based on installation criteria, and geography.
Service Pre-Inspection
Before a request for service is accepted, an Innisfil Energy Services Limited representative will have to visit the premises to determine if the eligibility criteria can be met. After the visit Innisfil Energy Services Limited will notify the person requesting the service the outcome of the pre-inspection visit.
Installation Criteria
Customers are responsible for providing access to their property and the rental Sentinal Light, at reasonable hours. The Sentinal Light must be located in a convenient, safe, and accessible place at the premises, to ensure installation and maintenance of the Sentinal Light.
Geography
The customer's premises must be within the boundaries of Innisfil.
Post Installation
Only authorised employees or agents of Innisfil Energy Services Limited may service the Sentinal Light.
Equipment
Customers accept responsibility for safeguarding the Sentinal Light on their premises.
Maintenance
Innisfil Energy Services Limited will repair or replace the Sentinal Light or component that fails due to ordinary wear and tear (certain exceptions may apply). Maintenance will be performed at a time mutually agreeable with the customer and the service technician, during normal working hours. Sentinal Light service calls will not be serviced on a weekend nor holiday. Sentinal Lights will be serviced during daytime hours on any day that arrangement can be made.
Liability
Innisfil Energy Services Limited assumes no responsibility and shall not be liable for any injury, loss or damage to persons or property that may result from or be connected with the Sentinal Light or its presence on the customer's premises.
Innisfil Energy Services Limited does not guarantee that the service will be uninterrupted or error-free.
The customer shall indemnify IESL from (or, in other words, compensate and reimburse IESL for) all losses and expenses IESL may incur, and the customer will hold IESL harmless from (or, in other words, protect and defend IESL in/against) any lawsuits and any claims which may be made against IESL, in connection with the customer's use or misuse of the service or violation of the Agreement.
Amendment to Agreement
IESL may change or replace any of the terms of the Agreement at any time, by providing the customer with at least 30 days' prior notice. IESL will send the customer any notices at the address to which bills are sent.
Assignment
The customer cannot transfer his/her rights or obligations under the Agreement or his/her access to any or all of the supply of the service to anyone else without IESL's prior written consent.
Suspension and Termination
The customer must inform IESL in writing of any change in the bank account or credit card account information provided. If the customer has indicated that charges for use of the service to be paid on his/her credit card account or debited from his/her bank account and such account is closed or otherwise not in good standing without prior written notice to IESL, access to the service may be suspended or terminated.
If IESL does not receive all amounts owed by the customer or if the customer fails to comply with any term or condition of the Agreement, IESL has the right to terminate the Agreement on not less than 5 days' written notice.
Notwithstanding any other term or condition in the Agreement, IESL may terminate the service at any time (including, prior to commencing to provide the service) by providing the customer with at least 30 days' prior written notice.
Closing an Account
Thirty-days notice is required from a customer wishing to discontinue his/her Sentinal Light rental service. Upon termination of the rental arrangement, we will enter the property to remove our rental equipment, as well as all associated wiring that was installed as part of the rental agreement.
Disconnection
We may disconnect rental equipment when accounts are not paid, though we prefer to help customers keep their accounts in good standing. We encourage customers who encounter temporary financial hardship to call us to discuss payment options.
Billing, Payments, Deposits and Late Payments
Each bill is due and payable in full by the due date on the front of the bill. If the customer has authorized IESL to charge his/her credit card account or to draw on his/her bank account for the purpose of satisfying amounts owing to IESL, the amount of the bill will be charged to the customer's credit card account or debited to the customer's bank account no sooner than 20 days after the date of the bill. Otherwise, payments may be made by cheque through the mail to the address indicated on the payment envelope included with the bill, and the cheques must be received by the due date on the front of the bill. Do not send cash through the mail.
If payment is not received by the due date (which will be shown on the bill), a late payment charge of 1.5% compounded and calculated monthly (34.5% on an annualized basis) will be applied to the total past due balance. The customer will be charged $25.00 for any cheque that is returned unpaid, for any credit card payment that cannot be processed for any reason and for any pre-authorized bank debit that cannot be processed for any reason.
Sentinel Light Monthly Rates:
70 watt high pressure sodium - $4.80 metered or $7.56 unmetered
150 watt high pressure sodium - $4.80 metered or $10.31 unmetered
